We value your privacy. This Privacy Policy applies to your usage of all software and services provided by Micro Merchant Systems.

Welcome to Micro Merchant Systems (MMS). MMS (“Micro Merchant Systems,” “MMS,” “we,” “us,” or “our”) provides technology-based solutions that support pharmacists in their work to build healthier communities (such services, together with the Sites and the “Services”) to our MMS customers and end users (“Customers”, “you,” or “your”). We provide information about the Services through our website available at https://www.primerx.io/ and other MMS websites (each a “Site” and together the “Sites”).

This Privacy Policy explains what Personal Data (defined below) we collect in connection with or through the Services, how we use and share that data, and your choices concerning our data practices. This Privacy Policy does not apply to any third-party applications or software that may integrate with the Services or any other third-party products, services or businesses, nor does it apply to Personal Data relating to Customers’ End Users that we process in the course of providing our Services to our Customers. Such information is processed pursuant to our agreements with our Customers.

By providing us with your Personal Data or accessing or using the Services you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access or use the Services or provide us with your Personal Data. INFORMATION WE COLLECT

When you contact us or interact with the Services, we collect information that alone or in combination with other information could be used to identify you (“Personal Data”) as follows:

User Information

If you are a User, we collect the following type of information that you provide in connection with your use of the Services. Certain information about you is also logged automatically in our systems, as described in the “Information Collected Automatically” section below.

Information Collected from Site Visitors

We collect information that you provide when you interact with our Sites, such as when you request content, register for an event, contact our sales team, or otherwise communicate with us. The information we may collect from you is described below.

Micro Merchant Systems Customers

If you are an MMS Customer, we may collect certain Personal Data about you as described below. Certain information about you is also logged automatically in our systems, as described in the “Information Collected Automatically” section below. Information Collected Automatically

When you visit, use and interact with the Services, we may receive certain information about your visit, use or interactions. For example, we may monitor the number of people that visit our Sites or use our Services, peak hours of visits, which page(s) are visited on our Sites, the domains our visitors come from (e.g. Google, Yahoo, etc.), and which browsers people use to access and visit our Sites (e.g., Chrome, Firefox, Microsoft Internet Explorer, etc.), broad geographical information, and Site-navigation pattern. In particular, the following information is created and automatically logged in our systems:

Protected Health Information ("PHI")

As part of our Service offerings, we may provide services to health care provider clients that are “covered entities”, as such term is defined under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (“HIPAA”). While we are not a covered entity, we may serve as a “business associate” to such clients. To the extent that we are deemed a “business associate”, we may be subject to certain provisions of HIPAA with respect to PHI, which is information that relates to your past, present, or future physical or mental health or condition and related health care services. Any PHI to which we obtain access through a covered entity is subject to specific protections under HIPAA and will be used and disclosed only in accordance with such applicable law. Any information that does not constitute PHI may be used or disclosed in any manner permitted under this Privacy Policy or as you may authorize, as permitted by applicable law.

How We Use the Information

SHARING AND DISCLOSURE OF INFORMATION

DATA RETENTION

We keep Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a legitimate business need to do so, or as required by law (e.g., for tax, legal, accounting or other purposes), whichever is the longer.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences until you opt out of receiving these communications and in accordance with our policies.

To determine the appropriate retention period for your Personal Data, we will consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we use your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymize your Personal Data so that it can no longer be associated with you, in which case it is no longer Personal Data.

CHILDREN

The Sites and the Services are not directed to children who are under the age of 13. MMS does not knowingly collect Personal Data from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Data to MMS through the Sites or Services please contact us at [email protected] and we will endeavor to delete that information from our databases.

CALIFORNIA VISITORS

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. LINKS TO OTHER WEBSITES OR SERVICES

The Services may contain links to other websites or services not operated or controlled by MMS (“Third Party Services”). The information that you share with Third Party Services will be governed by the specific privacy policies and terms of service of the Third-Party Services and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third-Party Services directly for information on their privacy practices and policies.

COOKIES AND OTHER TECHNOLOGIES

We and our partners use cookies, device identifiers and other similar technologies to operate and administer our Services, making it easier for you to use the Sites during future visits, and gather usage data on our Services.

Cookies and other similar technologies can be stored on your computer or device for different periods of time. For example, some cookies expire after a certain amount of time, or upon logging out (session cookies), others survive after your browser is closed until a defined expiration date set in the cookie (as determined by the third party placing it) and help recognize your computer when you open your browser and browse the Internet again (persistent cookies). Pixel tags or “clear” gifs are small images on a web page or in an email. Analytics / Performance: Used to recognize and count the number of Sites visitors and to gather statistics regarding how visitors move around the Sites (including number of page views, number of visitors, and time spent on each page). This helps us improve the way our Sites work and your experience on it, for example by making sure you can find what you need easily. These tools are used to help us analyze how you interact with the Services and Sites and enable us to personalize user experience, including through marketing communications. LinkedIn: LinkedIn sets cookies on the Sites to allow interaction with LinkedIn from our Sites and to enable behavioral advertising and analytics by LinkedIn. Facebook: Facebook, Inc. provides technologies that enable us to serve users with ads on Facebook based on their visit to and interaction on the Sites. Facebook’s pixels allow user behavior to be tracked after they have been redirected to our Sites by clicking on a Facebook ad. Please note that if you limit the ability of the Sites to set cookies, you may be unable to access certain parts of the Sites and you may not be able to benefit from the full functionality of the Sites.

Online Tracking and Do Not Track Signals: We and our third-party service providers, including Facebook, may use cookies, pixels, or other tracking technologies to collect information about your browsing activities over time and across different websites following your use of the Sites and use that information to send targeted advertisements. Our Sites currently do not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do respond to DNT signals in the future, we will update this Privacy Policy to describe how we do so.

SECURITY

You use the Services at your own risk. We comply with industry standards to protect Personal Data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. For example, we use available technology and other techniques to implement systems like firewalls, and/or encryption to secure data transfers. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Services, or e-mail. Please keep this in mind when disclosing any Personal Data to MMS via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained in the Services or third-party websites.

YOUR CHOICES

Whether or not you provide Personal Data to us is completely up to you, but if you choose not to provide information that is needed to create an account for or use some features of the Services, we may be unable to provide you with the Services. You can also contact us to access, update, correct, or remove your Personal Data from the Sites.

CHANGES TO THE PRIVACY POLICY

The Sites, the Services, and our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by applicable law. By continuing to use the Sites or the Services, or by providing us with Personal Data after we have posted an updated Privacy Policy, or notified you if applicable, you consent to the revised Privacy Policy and practices described in it.

INTERNATIONAL TRANSFER

MMS is based in the United States. If you are accessing the Services from the EEA, the UK, Latin America, or other regions with laws governing data collection and use, please note that we may transfer your Personal Data to the United States for the purposes described in this Privacy Policy, and the data may be transmitted to our service providers supporting our business operations (described above). The United States may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. Transfers of your Personal Data to MMS to the United States are necessary to perform the agreement we have entered into, or are about to enter into, with you.
